Youngsters Having Grown up in Germany have Right to Return

§16 AuslG (now §37 AufenthG) gives the Right of Return to such foreigners who grew up in Germany. Subsection 2 of this paragraph grants an exception for hardship cases. BVerwG (re 1 C 19.01 of March 19, 2002) ruled that such a hardship is to be seen, when a foreigner does not totally fulfill one or the other prerequisite but overfulfills other requirements of the law. Authoritative is however, that the overall view of the circumstances show that the non-German complies with the normative picture of an integrated foreigner.
